Terms of Service

1. Acceptance of Terms

By downloading, installing, or using DrumShed™ ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

DrumShed is a drum practice application that provides metronome drills, beat and fill creation tools, real-time timing feedback, AI-assisted practice planning, and play-along features. The App is designed for personal, non-commercial use.

3. Account Registration

You may create an account using Sign in with Apple or Sign in with Google. You are responsible for maintaining the security of your account and for all activities that occur under your account. You must be at least 13 years old to create an account.

By creating an account you agree to receive account-related emails (security alerts, sign-in links, billing receipts, and other messages necessary to operate your account). These transactional messages are sent whenever required and cannot be turned off while the account exists. Marketing emails (product updates, offers, and promotions) are sent only if you opt in during signup or in Settings → Notifications, and you can opt out at any time.

4. Subscriptions and Payments

Free and Paid Features

DrumShed offers both free features and paid subscription tiers. Free features may be limited in functionality compared to paid tiers.

Billing

All subscriptions are processed through Apple's App Store. Payment terms, renewal, and cancellation are governed by Apple's terms. You can manage or cancel your subscription at any time through your Apple ID settings.

Refunds

Refund requests must be directed to Apple in accordance with their refund policies. We do not process payments or refunds directly.

5. User Content

Your Content

You retain ownership of content you create in the App, including custom beats, fills, and drill configurations. By sharing content through the App's community features, you grant DrumShed a non-exclusive, worldwide license to display and distribute that content within the App.

Community Guidelines

Shared content must not contain offensive, harmful, or inappropriate material. We reserve the right to remove content that violates these guidelines without notice.

6. Third-Party Services

YouTube

The App integrates with YouTube API Services to enable video playback for play-along practice. Your use of YouTube features is subject to YouTube's Terms of Service. You may revoke the App's access to your YouTube data at any time via Google's security settings.

Apple Music

If you connect Apple Music, playback is governed by your existing Apple Music subscription terms. The App accesses only playback controls and does not access your library data.

AI Features

AI-generated content (drill suggestions, beat generation, practice advice) is provided as-is and may not always be accurate or suitable for your skill level. Use AI suggestions as guidance, not as a substitute for instruction from a qualified teacher.

7. Intellectual Property

The App, including its design, code, content, and branding, is the property of DrumShed LLC and is protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the App.

8. Disclaimers

  • The App is provided "as is" without warranties of any kind, express or implied.
  • We do not guarantee uninterrupted or error-free operation.
  • Timing feedback and practice metrics are approximate and depend on your device hardware and audio setup.
  • AI-generated content may contain errors and should not be relied upon as professional instruction.

9. Limitation of Liability

To the maximum extent permitted by law, DrumShed LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to loss of data, practice progress, or subscription fees.

10. Termination

We may suspend or terminate your access to the App if you violate these Terms. You may stop using the App and delete your account at any time. Upon termination, your right to use the App ceases immediately.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes through the App. Continued use of the App after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the State of Wisconsin, United States, without regard to conflict of law principles.
